Job Summary

Champion Compliance and Ethics Program for Augusta University (AU), which shall ensure that all entities of AU, and the other entities associated with the AU have identified their applicable compliance responsibilities; that they have implemented appropriate policies, procedures, and education; and that compliance is effectively monitored.

The Assistant VP Ethics & Compliance is responsible for the creation, oversight, implementation, strategic planning, and day-to-day decision making and operations of the Compliance & Ethics program for AU. The Assistant VP Ethics & Compliance will assist in ensuring that the affairs of AU are conducted in accordance with applicable federal, state, and local laws. In addition, the Assistant VP Ethics & Compliance shall assist in promoting a culture of compliance and ethics, while maintaining a focus on customer service and process improvement. This position will protect sensitive and confidential data and documentation.

The Assistant VP Ethics & Compliance will report to the Vice President for Audit, Compliance, and Enterprise Risk Management.

Responsibilities

Create, implement and operate all Augusta University Compliance & Ethics Programs. Keeping up-to-date with changes in the enforcement and regulatory environment, ensuring the AU is kept current and compliant with emerging, applicable federal and state legislation, adjusting and amending the AU as appropriate.

Maintain supervision of Minors on Campus Program, serve as policy manager, ensure compliance with USG Guidelines, and serve as a liaison with the System Office.

Serve as a collaborator and committee member for non-research Conflict of Interest (COI) cases.

Oversee Compliance communications and outreach.

Serve as the Institutional leader and liaison for USG; including Values Week.

Responsible for strategic planning and institutional goal setting for Augusta University Ethics & Compliance.

Conduct risk assessment for all applicable areas to identify challenges and create process improvement.

Provide oversight for OIG Exclusions Process and maintenance of vendor contracts.

Serve on various enterprise committees and institutional review boards.

In collaboration with the VP-ACERM, ensure the AU Compliance & Ethics Program operations are appropriately communicated to the appropriate USG Vice Chancellors and affiliate offices, Executive ACERM Steering Committee, AU President and AU Executive Leadership, and partnering Vice Presidents, Deans, and Directors.

Maintain collaborative relationships with Chief Human Resource Officer, General Counsel, Provost, AVP of Access, Success, and Belonging, SVP of Research, Chief Audit Officer, Principal Investigator and Policy Administrator (Privacy), Director of Ethics & Compliance for Research, Chief Compliance and Privacy Officer for the Health System, and other senior level executives and business units to effectively minimize compliance risks in these important compliance areas.

Develop and maintain partnerships with leaders of clinical components through a deep understanding of an academic medical institution and their compliance related needs.

Supervise University Title IX Office.

Provide strategic leadership of institutional efforts aimed at Title IX compliance and adherence to the Augusta University Sexual Misconduct Policy.

Manage relationships with University System of Georgia Office of Legal Affairs and System Director for Equity & Investigations to ensure compliance with USG and federal guidelines.

Assist with overall compliance with the Clery Act and other associated state and federal regulations to include identifying and training Campus Security Authorities (CSA). Support the annual creation and publication of the federally mandated AU Annual Safety Report.

Ownership of all AU Compliance and Ethics Hotline management; triage, and investigation of the AU/USG NAVEX reporting system.

Maintain processes and access points to receive complaints and procedures to protect the anonymity of complainants and to protect whistleblowers from retaliation.

Oversee all institutional grievances and complex hotline investigations with a deep understanding of institutional policies, procedures, and utilization of conflict resolution tools.

Provide judgement to and partner with the USG System Level Office of Ethics & Compliance, as appropriate.

Serve as Policy Manager for all University Ethics & Compliance related policies.

Develop and/or monitor a system to respond to allegations of improper/illegal activities for AU and the enforcement of appropriate disciplinary action against workforce members who have violated compliance policies, applicable statutes, regulations or Federal or State health care program requirements.

Respond to concerns and/or information requests initiated externally by both state and federal governmental agencies as well as non-governmental agencies. Determine and carry out appropriate action in collaboration with legal counsel and senior leadership of the University.

Collaborates with Human Resources to ensure effective education and training programs for AU workforce and students.

Supervise NCAA Compliance Officer. Ensure compliance with NCAA, USG, and AU institutional rules, policy, and procedure. Work with NCAA CO and AU Athletic Director on handling grievances, managing gifts and gratuities, and investigations.

Conduct Athletic Triage Group meetings with Compliance, Athletics, Human Resources, and Legal to ensure transparency, communication, partnership building, and information sharing.

Required Qualifications

MBA and 5 years' experience in a compliance or similar role in an institution of higher education

Must be able to attain Certified Compliance & Ethics Professional (CCEP) or other equivalent certification within 12 months accepting position.

Supervisory experience in a compliance role.

Preferred Qualifications

- Law degree (JD) from an accredited law school;
- Significant experience in a higher education compliance environment
- 5 years experience in an academic medical setting.
- experience working in a health care setting.
- Advanced knowledge of regulatory compliance in areas such as: athletics compliance, Title IX compliance, conflicts of interest, FERPA, exports control and privacy and confidentiality requirements for clinical research.
- Significant experience in strategic planning
